Competition and regulatory matters are increasingly resolved by the Courts, or by specialist appellate bodies. This requires individual experts with the skills and competence to draft expert reports and present economic analysis and evidence to withstand forensic cross-examination by counsel.
CASE economists provide expert reports in competition cases before judges and arbitral tribunals in contested proceedings under competition, regulatory and commercial law.
CASE has undertaken work in international arbitrations, contract disputes, regulatory and competition law appeals, judicial review, and private enforcement of competition law and follow-on damage suits.
CASE has considerable experience in quantifiying damages and overcharges in private actions. It has been involved in some of first damage actions including Camera Care in the 1980s,the recent landmark decision in Crehan v Inntrapreneur, and Deans, BCL and other cases.
CASE economists have also appeared as expert witnesses in a number of recent cases involving mergers, predation, abuse of dominance, and judicial review of regulators’ decisions before Courts in England and Wales, Scotland, Ireland, Finland, Netherlands, Australia and New Zealand.
