Cartels
Competition authorities are waging a war against cartels. Prosecutions, fines and damage claims have grown significantly. The European Commission is committed to 10 major prosecutions a year, and is pushing to make damage and class actions easier. Some Member States have made price-fixing a criminal offence.

These developments increase significantly the exposure of companies potentially vulnerable to cartel allegations, and the prospect of compensation for those who have been overcharged.

CASE has an experienced cartel practice. We have assisted companies in dealing with EC Commission and national competition authority investigations, with overcharge and other damage claims, and in responding to fine calculations.

CASE's empirical study of the European Commission’s fining and enforcement practices has been widely acclaimed and of practical use to lawyers and companies. The latest version of Case's cartel database can be downloaded here
