Metcash, Market Power and Counterfactuals

Cento Veljanovski paper Metcash, Market Power, and Counterfactuals – The standard of proof in Australian and New Zealand competition laws” was given to the 20th Competition Law Conference on the 5th May in Sydney. The paper takes a critical look at the use of counteractuals in competition and merger investigations, and focuses on the controversy over the standard of proof required in Australian and New Zealand competition laws.  A substantially revised version of the merger section of this paper was published as “Mergers, Counterfactuals and Proof after Metcash”, Australian Business Law Review, 2012, Vol. 40.
