We provide guidance, and expert reports and testimony in group and the new opt-out consumer class actions in the UK and elsewhere. These are complex and costly proceedings, and the courts are still feeling their way. However it is now apparent that the Applicant’s economists’ expert report is a crucial in establishing the necessary common issues among the proposed class, and the methodology for the quantification of damages in the new UK collective certification process before the Competition Appeal Tribunal. We have so far acted for claimants, and hence are acutely aware of the evidential, procedural and funding obstacles they face. Our involvement in the largest damage claim in UK legal history, Merricks v MasterCard, representing 42 million consumers and estimated losses of £14 billion have equipped us to deal with claims of any size.
