Our July Casenote “CAT awards tripe damages, well not really” takes a critical look at the UK Competition Appeal Tribunal’s decision in Cardiff Bus.  There the CAT awarded compensatory and for the first time exemplary (punitive) damages in a follow-on damage action alleging predation.  The Casenote discusses whether the CAT’s view of causation was too narrow, and its confusing approach to exemplary damages. A version of this Casenote was published in the European Competition Law Review in early 2013.
